Summary of Key Terms and Conditions


This section is prepared in accordance with section 47A of the Fair Trading Act 1987 No 68 (NSW). The purpose of this notice is to ensure that you are aware of the substance and effect of the terms and conditions associated with the services that we provide that may substantially prejudice your interests.

Any defined terms in this section have the same meaning as in the InsightIQ Terms and Conditions (Agreement) unless otherwise stated. For the purposes of this document, T Garage - Strategy and Research Pty Ltd ACN 613 775 143 is referred to as "we/ us/ our" and the Member (you) is referred to as "you".

This section is only a summary of some of the key terms and conditions in the Agreement. You must read the Agreement in full before agreeing to them.

Key Terms

  1. Expiry of points: you have 1 year from the date you accrue any Points to redeem those Points for a Gift Card, after such time the Point will expire (clause 5.1);
  2. Liability limits: to the extent permitted by law, we make no representation or warranty of any kind in relation to any product or service acquired in connection with a Gift Card, and exclude all liability for any loss, damage, cost or expense that you incur in relation to any product or service acquired in connection with a Gift Card (clause 7);
  3. Communication limits: it is necessary for us to communicate with you as a Member of the Community via email, text or through the inbuilt messaging system in the Community, and you may not opt-out of receiving our communications without unsubscribing from the Community and in turn, forfeiting your outstanding Points (clause 8.4);
  4. Amendment to terms: we may amend the Terms from time to time at our absolute discretion, which will be communicated to you with written notice (clause 10.1) and your continued participation in the Community will indicate an acceptance of any such amendment (clause 10.3);
  5. Removal: we may remove you from an Activity or the Community at any time for any reason by providing you with written notice. Where we remove you from an Activity or the Community because of your breach of the Agreement, you forfeit your rights to all Points that you have (or would have) accumulated. (clause 11.2); and
  6. Personal information: we may use your Personal Information in accordance with our Privacy Policy for certain purposes such as to verify the validity of your participation in the Community, your identify, age and place of residence and the accounts you hold (clause 8.1).



  1. Terms and Conditions
    1. These terms and conditions (Terms) apply to the Member's ('you', 'your') participation in the Community on the Platform administered by T Garage - Strategy and Research Pty Ltd ACN 613 775 143 ('we', 'us', 'our').
    2. These Terms govern:
      1. how you can earn Points by completing Activities;
      2. how you can redeem Points for a Gift Card; and
      3. the conditions of your participation as a Member.
    3. By accessing or participating the Community, you expressly agree to be bound by these Terms, together with the Member Terms and any applicable Activity Terms (together, the Agreement).
    4. We hold the benefit of this Agreement on trust for our Sponsors.
  2. Eligibility and participation

    1. How do I take part in an Activity?

      You can complete Activities as part of your participation in the Community.

    2. Are there any eligibility requirements for an Activity?

      Yes. There are specific eligibility requirements for each Activity offered through the Community. Your eligibility will be assessed as part of our screening process and you will be notified if you are not eligible, or become ineligible, for an Activity.

    3. What are the Activity Terms?

      There may be additional terms imposed by us and/or the Sponsor that govern your access or participation in an Activity. Where there are Activity Terms associated with an Activity, you will not be permitted to use, access or participate in the Activity until you have read, understood and agreed to the Activity Terms. In such cases, the Activity Terms form part of this Agreement in accordance with clause 1.3.

  3. Earning Points

    1. How do I earn Points?

      You can earn Points by completing Activities, engaging and contributing to the site and for referring friends to the site. Any Points you earn will be credited to your Member Account within 3 days of the date they are earned.

    2. How many Points can I earn?

      The number of Points you can earn will vary between Activities. Each Activity will display the maximum number of Points that you can earn for completing that Activity, which may vary depending on whether you meet the criteria to participate in the Activity and your level of progression in respect of the Activity.

    3. What is the monetary value of my Points?

      1 Point has the equivalent value of 1 cent.

    4. Will my Points ever be forfeited?

      Your Points will only be forfeited if they have been awarded in error or otherwise in accordance with clause 12.

  4. Refer A Friend

    You can earn points for referring friends to the site.  

    1. You can only earn points for Successful Refer a Friend events to the Site
    2. The number of points rewarded to you for each Successful Refer A Friend can be viewed on the My Referrals section of the site.
    3. There may be a limit to the total number of points you can earn for Successful Refer A Friends. This limit can be viewed on the My Referrals section of the site
    4. The number of points rewarded per Successful Refer A Friend and the total number of points a you can earn for Successful Refer A Friends may change from time to time. You will earn points based on these values at the time your friend completes the Successful Refer A Friend process which may differ to the values that were displayed when you shared your Unique Referral Link.


  5. Redeeming Points for a Gift Card

    1. How do I redeem my Points?

      You can redeem your Points for a Gift Card on the Platform. In doing so, you acknowledge and agree that:

      1. you can only redeem your Points for a Gift Card once you have accumulated the equivalent value of 5 dollars;
      2. Points may only be redeemed for a Gift Card using our inbuilt mechanism; and
      3. the maximum redemption of Points for a Gift Card is limited to an equivalent of 100 dollars per day.
      4. to redeem a gift card you must have a mobile phone to receive an SMS code in order to verify your identity.

      Note: any reference in these Terms to dollars or monetary value is considered in relation to Australian dollars.

    2. What Gift Card will I get?

      You may choose from any of the Gift Cards that we offer, and for which you are eligible, on the Website. The Gift Cards that we offer on the Website may change from time to time and, to the extent permitted by law, we make no guarantees about the availability of any particular vendor's Gift Card.

    3. Will any other terms apply to my Gift Card?

      Yes, the suppliers or providers of the Gift Card or of the products or services offered in connection with a Gift Card may have their own terms and conditions which will apply in conjunction with this Agreement. It is your responsibility in each case to read, understand and accept these terms and conditions before proceeding with your Gift Card redemption. 

  6. Managing your Points
    1. How long do I have to use my Points?

      Your Points will expire 1 year after the date that they have been credited to your Member Account unless cancelled or forfeited earlier in accordance with clause 11.

    2. How can I keep track of my Points balance?

      You can view your Points balance at any time via your Member Account.

    3. Can I transfer or exchange my Points?

      No. Your Points are awarded on a personal basis and are not transferrable, exchangeable or redeemable for cash.

    4. Can I combine my points with another member?

      No, you may not combine your Points with any Points belonging to another member.

  7. Communication with members and other responsibilities

    You will have the opportunity to upload Member Content as part of your participation in the Community. You will also view and have the opportunity to comment on Content uploaded by other members in the Community. It is important that you are considerate and respectful in your interactions with other members and when posting your own Member Content as it may be made public and you are solely responsible for your actions. We and the Sponsor may edit, refuse to post or remove any member (including you) or Member Content which does not comply with these Terms.

    You must follow all other reasonable instructions that we and/or the Sponsor give you in relation to your participation in the Community on the Platform.

  8. Disclaimer

    To the extent permitted by law, we make no representation or warranty of any kind in relation to any product or service acquired in connection with a Gift Card, and exclude all liability for any loss, damage, cost or expense that you incur in relation to any product or service acquired in connection with a Gift Card.

  9. Personal Information
    1. How will my Personal Information be used?

      As part of becoming a Member you will have provided us with certain Personal Information. We will only ever use your Personal Information strictly in accordance with our Privacy Policy. This use may include verifying the validity of your participation in the Community, including your identity, accounts held, age and place of residence.

    2. How do I update my details?

      You can update your details at any time by accessing your Member Account. You must ensure that your contact details are up-to-date at all times.

    3. Will I receive communications from you or the Sponsor?

      You may receive communications from us and our Sponsors by email or text, or through the Community, in connection with Activities or the Community.

    4. Can I opt-out of receiving communications from you or the Sponsor?

      All of the communications you receive from us are necessary for you to receive as a Member of the Community. As such, you cannot opt-out from these communications without unsubscribing in accordance with clause 11.

  10. Contacting us

    We use all reasonable efforts to ensure that Points are credited and debited appropriately, however, you should review your account to ensure that your Points balance accurately reflects your participation in the Activities. If you believe that your Member Account was not credit or debited correctly, or reflects incorrect redemption transactions, please contact us via the Website.

  11. Changes to these Terms
    1. We may amend these Terms (including any aspect of the Activities, Community or Points) from time to time at our discretion. We will provide you with written notice of any such amendment.
    2. You may exit the Community in response to any amendment we make under clause 10.1. In such circumstances, we will round up your Points balance to the nearest 5 dollar amount and will allow you to redeem the Gift Card of your choice.
    3. Your continued participation in the Community indicates your acceptance of any amendment or replacement of these Terms.
  12. Exit and removal
    1. How do I unsubscribe from the Community?

      You can unsubscribe from the Community at any time. Where you voluntarily unsubscribe from the Community, your Member Account will be de-activated and you will forfeit your rights to all Points that have (or would have been) accumulated as a result of your participation in the Community, or in any Activities related to that Community. 

    2. Can I be forced to leave an Activity or a Community?

      Yes, we can remove you from an Activity or the Community at any time for any reason by providing you with written notice.

      Where your removal from an Activity is a result of your breach of this Agreement, you forfeit your rights to all Points that have (or would have been) accumulated as a result of your participation in that Activity.

      Where your removal from the Community is a result of your breach of this Agreement or your Inactivity, your Member Account will be deactivated and you forfeit your rights to redeem any outstanding Points. In all other cases, we will round up your Points balance to the nearest 5 dollar amount and allow you to redeem a Gift Card before de-activating your Member Account.

  13. Meaning of Important Words

    Activities

    means activities within the Community that you participate in as a Member, including:

    (a) surveys, polls, research, focus discussion groups, online forums, chat sessions, promotions, competitions, games, incentives and marketing activities; and

    (b) sampling, consuming and using Products.

    Activity Terms

    means terms notified to you by us or the Sponsor which are additional to these Terms and apply to an Activity.

    App

    means the InsightIQ mobile application.

    Community

    means the SaySo community.

    Content

    means any content, information, review, comment, testimonial, conversation, report, survey response, text, image, video, recoding, creative works or writings, reference, link, resources, or other material in the Community.

    Gift Card

    means a prepaid debit card that can be exchanged for a specified cash value of goods or services from a particular business.

    Inactivity

    means a period of 12 months during which the Member fails to complete Activities or create Member Content in the Community. 

    Member

    means the individual who has been invited to be a Member, and has accepted and been granted membership of the Community, in accordance with the Member Terms.

    Member Account

    means the Member''s personal account in the Community.

    Member Content

    means any Content that is uploaded, transmitted, distributed, created, produced, submitted or provided by you or any other person accessing the Community or participating in an Activity using your username and password.

    Member Terms

    means our member terms which can be found at https://my.sayso.com.au/Page/TermsAndConditions.

    My Referral Section

    means the screen available at https://my.sayso.com.au/MyAccount#myreferrals

    Personal Information

    has the meaning given in the Privacy Act1988 (Cth).

    Platform

    means the InsightIQ research platform and includes:

    (a) the App;

    (b) https://my.sayso.com.au

    (c) the Third Party Software; and

    (d) all related software upgrades and updates, add-on components, web services, supplements and other material provided by us.

    Platform Content

    means:

    (a) any Content that is uploaded, submitted, distributed or provided by us or the Sponsor; and

    (b) any Content that is uploaded, submitted, distributed or provided by a member other than you.

    Points

    means the digital tokens awarded for participation in Activities on the Platform.

    Privacy Policy

    means our privacy policy located at https://my.sayso.com.au/Page/PrivacyPolicy.

    Products

    means the products and services of the Sponsor and third parties.

    Sponsor

    means the person who has commissioned or sponsored the Community (and sometimes, we are that person).

    Successful Refer A Friend

    means a person other than yourself that uses your Unique Refer A Friend Link to join the site, completes the sign up process including verifying their email address and mobile phone number and completes at least 1 Activity.

    Terms

    has the meaning given in clause 1.1.

    Third Party Software

    includes open source software and means software:

    (a) in which the IP is owned by a third party; and

    (b) which is incorporated in, or integrated or linked with, the Platform (or capable of being incorporated in, or integrated or linked with, the Platform).

    Unique Refer A Friend Link

    means the link displayed on the My Referrals section of the site. This link is unique to you and is used to track friends that you have referred to the site. Only friends using this link will be considered as being referred by you.

    Website

    means our website located at https://my.sayso.com.au.
